New York, NY (November 27, 2024) – Fr. Emmanuel Lemelson today filed an opening brief with the U.S. Court of Appeals for the First Circuit seeking to reverse a lower court’s denial of attorney’s fees and costs stemming from his landmark victory over fraudulent SEC charges.

In July 2024, the U.S. District Court affirmed Lemelson as a “prevailing party” in his case against the SEC. This followed a November 2021 trial in which a federal jury overwhelmingly rejected the agency’s fraudulent allegations. This appeal seeks to hold the SEC accountable for the substantial costs incurred during the protracted legal battle.
“The SEC is a corrupt, captured regulator,” said Lemelson. “Our fight to recover millions in legal fees isn’t over. Sadly, taxpayers won’t reclaim the millions squandered on a spiteful case aimed at silencing a whistleblower and shielding fraud at Ligand Pharmaceuticals (NASDAQ: LGND), which fleeced taxpayers, led to billions in investor losses and put patients at risk,” Lemelson added.
